Terms of Service

These Terms of Service ("Terms") govern your use of the DFP AI Builder platform operated by Designed For Perfection ("DFP," "we," "us," or "our"). By creating an account or using the platform, you agree to these Terms.

1. Eligibility

You must be at least 16 years old and legally capable of entering into a binding agreement to use the platform.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

3. Acceptable Use

You agree NOT to:

Use the platform for any illegal purpose
Upload malicious code, viruses, or harmful content
Attempt to access other users' accounts or data
Reverse engineer, decompile, or exploit the platform's infrastructure
Use the platform to send spam or conduct phishing attacks
Overload the platform with automated requests or denial-of-service attacks

4. Your Content & Projects

You retain full ownership of all code, content, and projects you create. DFP AI Builder is local-first: projects are intended to be stored on your device, and you may export them as ZIP files at no extra charge. We do not claim intellectual property rights over your work. We may access project data only to provide the service, troubleshoot issues, or comply with law.

5. AI-Generated Code

The platform uses AI to generate code and suggestions. AI-generated code is provided "as-is." You are solely responsible for reviewing, testing, and deploying any AI-generated code. We make no warranties regarding the accuracy, security, or fitness of AI-generated output.

6. Subscriptions & Billing

Paid plans are billed monthly via Stripe and include a subscription fee plus credited AI Fuel for premium actions (e.g., Architect mode, additional Syntax messages beyond your daily included allowance, new app generation, optional Cloud go-live). Per-use Fuel rates are disclosed in the application when you take those actions. You may cancel anytime from Plan & Billing; cancellation takes effect at the end of the current billing period. Refunds are at our discretion.

7. Service Availability

We strive for high availability but do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages. We are not liable for any loss or damage resulting from service interruptions.

8. Cloud Go-Live (Optional Hosting)

Hosting is optional. If you enable Cloud go-live, selected projects may be hosted on DFP infrastructure subject to your plan's included slots and applicable AI Fuel charges. We may suspend or remove hosted deployments that violate these Terms, consume excessive resources, or pose security risks. Projects not using Cloud go-live remain on your own storage.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DFP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE PLATFORM.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time from your account settings. Upon termination, your projects and data will be deleted within 30 days.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Canada. Any disputes shall be resolved in the courts of the Province of Ontario.
